Late Payment Fees
In accordance with legislation, interest is charged at 10% per annum on all overdue levies.
An arrears processing fee may also be applied each time a recovery action is initiated by your scheme, including the issuing of overdue levy notices.
Arrears Notices & Interest Charges
Maintaining a consistent and reliable cash flow is essential for all strata, neighbourhood, and community title schemes. These funds support critical services such as insurance, electricity, water usage, and cleaning.
Unlike utility providers, strata and community schemes cannot suspend services to owners who fall behind on levy payments. As a result, legislation provides mechanisms to ensure levies are paid on time.
Under the Strata Schemes Management Act 2015 and the Community Land Management Act 1989, schemes are entitled to charge interest on overdue levies and recover costs associated with arrears management and debt collection. These provisions ensure that compliant owners are not unfairly burdened by unpaid contributions.
Arrears Recovery Process
If levies remain unpaid past the due date, administrative processes are initiated to recover the outstanding amount.
Arrears processing fees may include costs such as printing, stationery, postage, and administrative labour.
For more significant debts, the Owners Corporation or Community Association may engage a debt collection agency or solicitor. Any associated recovery costs may also be charged back to the lot owner.
Disputing Fees
If you believe any charges have been applied incorrectly, you may request a review by submitting a motion at the next general meeting of the Owners Corporation.
All outstanding fees must be paid in full before submitting a motion for review.
